  Thank you for allowing Blue Boot Consignment & Resale to resell your items. Carefully read the Terms and Conditions below and initial each box denoting you agree and are fully aware of all Terms and Conditions provided in this contract. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to this Contract Agreement, or any additional terms referenced herein, you may not access the website or use any services. Blue Boot Consignment & Resale reserves the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to the Blue Boot Consignment & Resale website. It is Consignor, hereafter referred to as the “Owner” responsibility to periodically check the site for changes. Continued use and/or access to the website following the positing of any changes constitutes acceptance of any changes.

All merchandise uploaded to the website and approved/accepted for consignment will be issued a prepaid shipping label via the Owner’s e-mail address provided on this contract or a label can be mailed to the Owner via United States Postal Service, hereafter referred to as “USPS”, which is at the discretion of the Owner. All additional expenses such as insurance for shipped merchandise, shall be paid by the Owner. Be advised, the boxes/envelopes can not weigh more than 30 pounds nor exceed the dimension of 27 inches in length, 17 inches in width, or 17 inches in height. If the Owner exceeds the above-mentioned weight and/or dimensions, all additional cost will be paid at the Owner’s expense. The accepted merchandise can be dropped off at any USPS location.

All accepted merchandise for consignment must arrive in new, like new, or excellent condition and must be “ready to wear”. If merchandise arrives with major flaws, missing zippers, beads, tears, odors, fading, etc., the items will not be accepted by Blue Boot Consignment & Resale. These items will be returned/shipped back to the Owner at Owner’s expense within 7 calendar days of notice. The Owner will be notified at the e-mail address provided on this contract. If Blue Boot Consignment & Resale do not receive a response from the Owner within 7 calendar days, on the 8th day, the items will be donated, becomes property of Blue Boot Consignment & Resale, or discarded depending upon the condition of the item(s).

Once Blue Boot Consignment & Resale receives the Owner’s merchandise, all items will be screened for defects. If there are no defects, the accepted merchandise will be processed into inventory and posted on the website within 5-7 business days after arriving at Blue Boot Consignment & Resale.

The Consignment/Contract period is 90 calendar days from the date the merchandise appears on the website, hereafter referred to as the “posting date”. Blue Boot Consignment & Resale has the sole discretion in determining the pricing of all items and subject to any sales and/or promotions which may affect the final sale price. Blue Boot Consignment & Resale shall use its best effort to promote, display and sell items on its website, and shall have no obligation to promote items in any other manner. If the merchandise is not sold within 90 calendar days from the posting date, all items will be returned/shipped back to the Owner at Owner’s expense within 7 calendar days after the expiration date, on the 8th day, the items will be donated, becomes property of Blue Boot Consignment & Resale, or discarded depending upon the condition of the item(s). Although Blue Boot Consignment & Resale may attempt to notify the Owner of the expiration date, it’s the responsibility of the Owner to monitor the expiration date of their merchandise. Blue Boot Consignment & Resale may/may not contact the Owner regarding any expired posting date(s).

Blue Boot Consignment & Resale does not assume any liability for any loss, destruction, or damage of any kind to consigned items which includes but not limited to items damaged caused by fire, water, theft, lost packages, any types of stains/tears, and any other damages or losses without exclusion while merchandise is under the control of Blue Boot Consignment & Resale. Packing, shipping, insurance, and other handling expenses for merchandise from Blue Boot Consignment & Resale to the Owner shall be paid by the Owner. Blue Boot Consignment & Resale is not responsible for lost packages. We can not guarantee delivery by any specific time/date. Delays may be caused by weather which is beyond our control. We can not provide shipping labels for P.O. Boxes nor international addresses.

Forty percent (40%) of the selling price will be paid to the Owner (except where proceeds are donated to charity). Upon selling the merchandise, Blue Boot Consignment & Resale will provide the Owner with an itemized statement denoting items sold, price and Owner’s portion of payment.

The Owner has the option to be paid by check, which will be mailed via USPS, PayPal or Zelle normally within 7-10 business days after the item(s) are sold. If preferred payout option is USPS, a check will be mailed to the address provided on this contract. If the options are PayPal or Zelle, the payment will be submitted to the information provided by the Owner. It is the Owner’s responsibility to inform/update Blue Boot Consignment & Resale of any changes to mailing address, email address and/or phone number on record. Failure to provide updated information may result in lost payment(s) and/or merchandise. LOST PAYMENTS DUE TO NEGLIGENCE OF THE OWNER, TO INCLUDE PROVIDING

All modifications, deletion, additions, or amendments to this contract must be in writing and signed by both parties. This contract and lists(s) of inventory constitutes the entire agreement between the parties hereto.

The Owner represents and warrants the merchandise cosigned are 100% authentic as represented. If any merchandise provided to Blue Boot Consignment & Resale for resale by the Owner are found to be counterfeited and/or if Blue Boot Consignment & Resale incurs any liability due to the sale of such items, the Owner agrees to indemnify Blue Boot Consignment & Resale from any damages including any all judgments, liens, attorney fees, and fines.

This Contract and its enforcement shall be governed by and construed in accordance with the law of the State of Texas, without regard to the State of Texas principles of conflicts of law. The parties agree that any action or proceeding against another party hereto, arising out of or relating to the contract shall be brought only in the courts of Texas. All Terms of Service and a separate agreement whereby we provide you service(s) shall not be governed by and construed in accordance with the laws of the United States.

If the merchandise is older, the customer will be offered fifty percent of the ticket/retail price. If any merchandise arrives with defects, the Owner will be notified, and the original buyout amount will be adjusted accordingly. The Owner has the option to be paid by check, which will be mailed via USPS, PayPal or Zelle, usually within 5 calendar days after the merchandise has been screened for defects and accepted. If the preferred payout option is USPS, a check will be mailed to the address provided on this contract. If the options are PayPal or Zelle, the payment will be submitted to the account information provided by the Owner. It is the Owner’s responsibility to inform/update Blue Boot Consignment & Resale of any changes to mailing address, email address and/or phone number on record. Failure to provide updated information may result in lost payment(s) and/or merchandise. LOST PAYMENTS DUE TO NEGLIGENCE OF THE OWNER, TO INCLUDE PROVIDING INCORRECT ACCOUNT/PHONE NUMBERS WILL NOT BE REPSSIUED AND A $30 STOP PAYMENT FEE WILL BE CHARGED TO THE OWNER FOR ALL PAYMENTS STOPPED ON CHECKS.

Any party may terminate the above referenced agreement at any time with or without cause by providing written notice to Blue Boot Consignment & Resale, which will become effective the By signing below, you authorize Blue Boot Consignment & Resale to sell your merchandise on consignment pursuant to the terms described herein and acknowledge my agreement to the terms/conditions of this contract. I also acknowledge that I have received a copy of the contract terms and conditions.
